Terms of Service
These are the terms under which you may use Biotech Pulse (the iOS app and the website at bioturd.com).
1. Not investment advice
Biotech Pulse aggregates publicly available regulatory filings, company press releases, and biotech news coverage. Everything you see in the app is information, not investment advice. We are not your broker, your financial advisor, your accountant, or your lawyer. Before making any investment decision, verify the claim against the primary source (FDA.gov, company investor-relations page, SEC filing), and consult a licensed professional.
Nothing in the app — including push notifications, headline framing, badge color, or ticker tagging — constitutes a recommendation to buy, sell, hold, or short any security. You use this information at your own risk.
2. Data accuracy
We aggregate from reputable public sources but we cannot guarantee accuracy, completeness, or timeliness. Source feeds can have delays, format changes, or errors. Ticker extraction is automated and conservative but not perfect; an event may be tagged with the wrong ticker, no ticker, or missing a ticker that belongs. Always verify the original source linked on every event before acting on it.
3. Acceptable use
You may use Biotech Pulse for personal, non-commercial purposes. You may not:
- Scrape, crawl, or otherwise programmatically extract data from the app or our backend.
- Resell, redistribute, or republish our aggregated feed.
- Reverse-engineer the app or our API.
- Use the service in violation of any applicable law, including US securities laws.
4. Intellectual property
Source content (press releases, articles, FDA documents) remains the property of its respective owners. We display headlines, summary snippets, and links in accordance with fair use and standard RSS syndication. Biotech Pulse's branding, design, and compiled database structure are our property.
5. Disclaimers
The service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
6. Limitation of liability
To the maximum extent permitted by law, Biotech Pulse and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost trading gains, or missed trading opportunities, arising from your use of the service. Your sole remedy is to stop using the service.
7. Affiliate disclosure
The app is free. In future releases we may include affiliate links (for example to brokerage signup pages or premium biotech newsletters). When a link is an affiliate link, it will be clearly labeled. Affiliate relationships do not influence which events surface in the feed or which tickers are available.
8. Changes to the service
We may change, suspend, or discontinue the service at any time, including adding or removing data sources, features, or event categories.
9. Governing law
These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws principles, except as provided in section 11 below for consumers resident in the European Economic Area, the United Kingdom, or Switzerland. Any disputes arising under these terms shall be resolved in the state or federal courts located in New York.
10. Trader information and EU point of contact
For the purposes of Article 14a of the EU Consumer Rights Directive (as amended) and Articles 11 and 12 of the EU Digital Services Act (Regulation (EU) 2022/2065):
- Trader: MEAS Partners, LLC, a Delaware limited liability company.
- Registered address: 131 Continental Dr, Ste 305, Newark, DE 19713, USA.
- Contact email: hello@bioturd.com.
- Single point of contact for users and authorities under DSA Articles 11 and 12: hello@bioturd.com. Communications may be submitted in English.
Biotech Pulse does not host, store, or publicly disseminate user-generated content, and accordingly the DSA's content-moderation, notice-and-action, and transparency-reporting obligations applicable to "online platforms" (Articles 16 and 24 of the DSA) do not apply to this service.
11. Consumers in the EU/EEA, UK, and Switzerland
If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, nothing in these terms — including the limitation of liability in section 6 and the governing-law clause in section 9 — limits, excludes, or overrides any statutory right you have under mandatory consumer-protection law in your country of residence that cannot be derogated from by agreement. You retain the right to bring proceedings before the courts of your country of residence under the applicable consumer-protection rules. Where any provision of these terms conflicts with such a mandatory right, that provision is, to the minimum extent necessary, disapplied as to you.
