Terms of Service
These are the terms under which you may use LabelRx (the iOS app and the marketing pages at bioturd.com/labelrx).
1. Intended audience — licensed clinicians only
LabelRx is a reference tool for licensed healthcare professionals: pharmacists, physicians, advanced-practice nurses, physician assistants, residents, pharmacy and medical students operating under supervision, and other clinicians authorized to prescribe, dispense, or administer medications in their jurisdiction. The app is not intended for consumers seeking medication advice.
2. Not clinical decision support — not FDA-cleared
LabelRx is not a medical device and is not cleared or authorized by the FDA (or any other regulator) as a clinical decision support tool, diagnostic aid, or therapeutic device. Nothing in the app — including drug labels, dose calculators, interaction displays, substitution suggestions, therapeutic equivalence codes, pregnancy or lactation guidance, pharmacogenomic annotations, or clinical-trial summaries — constitutes a prescription, a recommendation to prescribe, or a substitute for the independent clinical judgment of a qualified licensed professional.
You must always verify any information in LabelRx against the current FDA-approved prescribing information, authoritative references such as Lexicomp or Micromedex, your institution's formulary and protocols, and your own clinical judgment before making any prescribing, dispensing, counseling, or administration decision. By using LabelRx, you accept full responsibility for clinical decisions made in your practice.
3. Data sources and accuracy
LabelRx aggregates publicly available data from FDA DailyMed, openFDA (FDA labels, adverse events, recalls, shortages), the FDA Orange Book, ClinicalTrials.gov, NIH RxNorm/RxNav, and the Clinical Pharmacogenetics Implementation Consortium (CPIC), among other public sources. Although we pull from authoritative primary sources, we cannot guarantee that data in the app is complete, current, or free of parsing errors. Source feeds may experience delays, format changes, or omissions, and our automated label parser may misinterpret formatting in any given label.
In particular:
- The "Label Co-Mentions" tool is not a drug-interaction database. It searches FDA label text for mentions of other selected drugs and infers a loose signal strength from label wording. It may miss clinically significant interactions and may falsely reassure on dangerous combinations. Always verify with a validated DDI reference (Lexicomp, Micromedex) and/or a pharmacist.
- Dose calculators are conservative starting-point tools. Results reflect published formulas (e.g., Cockcroft-Gault, CKD-EPI 2021, CDC 2022 MME, Mosteller BSA, Devine IBW) and are not prescriber authority. Always review against the FDA-approved label, institutional protocol, patient-specific factors, and your clinical judgment.
- Renal dose adjustments are surfaced from FDA label text when available. Absence of an adjustment in the app does not imply no adjustment is needed.
- Therapeutic equivalence (AB) codes are pulled from the Orange Book. State pharmacy substitution laws vary. Always confirm against your state board of pharmacy rules.
- Pregnancy and lactation guidance is shown from FDA PLLR narrative where available. Pre-2015 drugs may display legacy letter categories (A/B/C/D/X), which the FDA deprecated in 2015; these are provided for historical context only.
- Pharmacogenomic (PGx) annotations are drawn from CPIC Level A guidelines. They are informational; they are not a substitute for genetic testing review or pharmacogenomic consultation.
4. Not a substitute for the FDA-approved label
The FDA-approved prescribing information (the product's current package insert, available from DailyMed) is the definitive source. LabelRx summarizes and re-presents that information but is not a replacement for it. For any prescribing, dispensing, or administration decision, consult the current full prescribing information.
5. Acceptable use
You may use LabelRx for personal and professional reference in your practice. You may not:
- Scrape, crawl, or otherwise programmatically extract data from the app or our backend.
- Resell, redistribute, or republish the aggregated drug catalogue, parsed labels, or any derived content.
- Reverse-engineer the app or our API.
- Represent LabelRx output as your own clinical recommendation to patients.
- Use the service in violation of any applicable law, including the U.S. Food, Drug, and Cosmetic Act, HIPAA, or state pharmacy practice laws.
- Enter patient-identifying information (name, MRN, date of birth) into any calculator or input field. LabelRx is not designed to handle PHI.
6. Intellectual property
FDA drug labels, Orange Book data, FAERS reports, CPIC guidelines, and ClinicalTrials.gov records are U.S. government public-domain or non-copyrighted data. Third-party references (Lexicomp, Micromedex, etc.) are the property of their owners and are not redistributed by this app. LabelRx's branding, design, type system, compiled database structure, and original summary framing are our property.
7. Disclaimers and indemnification
The service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or fitness for clinical use. We do not warrant that the service will be uninterrupted, error-free, timely, or suitable for any clinical purpose.
You agree to indemnify and hold harmless MEAS Partners, LLC and its operators from any claim, loss, or damage arising from your use of LabelRx, including any clinical decision or patient outcome influenced by information you accessed through the app.
8. Limitation of liability
To the maximum extent permitted by law, MEAS Partners, LLC and its operators are not liable for any direct, indirect, incidental, consequential, special, or punitive damages — including adverse patient outcomes, medication errors, allegations of professional negligence, lost profits, or business interruption — arising from your use of the service. Your sole remedy is to stop using the service.
9. Changes to the service
We may change, suspend, or discontinue the service at any time, including adding or removing data sources, calculators, or features, or changing how specific data is surfaced in the interface.
10. Governing law
These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws principles, except as provided in section 12 below for consumers resident in the European Economic Area, the United Kingdom, or Switzerland. Any disputes arising under these terms shall be resolved in the state or federal courts located in New York.
11. Trader information and EU point of contact
For the purposes of Article 14a of the EU Consumer Rights Directive (as amended) and Articles 11 and 12 of the EU Digital Services Act (Regulation (EU) 2022/2065):
- Trader: MEAS Partners, LLC, a Delaware limited liability company.
- Registered address: 131 Continental Dr, Ste 305, Newark, DE 19713, USA.
- Contact email: hello@bioturd.com.
- Single point of contact for users and authorities under DSA Articles 11 and 12: hello@bioturd.com. Communications may be submitted in English.
LabelRx does not host, store, or publicly disseminate user-generated content, and accordingly the DSA's content-moderation, notice-and-action, and transparency-reporting obligations applicable to "online platforms" (Articles 16 and 24 of the DSA) do not apply to this service.
12. Consumers in the EU/EEA, UK, and Switzerland
If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, nothing in these terms — including the indemnification and limitation-of-liability provisions in sections 7 and 8 and the governing-law clause in section 10 — limits, excludes, or overrides any statutory right you have under mandatory consumer-protection law in your country of residence that cannot be derogated from by agreement. You retain the right to bring proceedings before the courts of your country of residence under the applicable consumer-protection rules. Where any provision of these terms conflicts with such a mandatory right, that provision is, to the minimum extent necessary, disapplied as to you. Nothing in this section limits the clinical-use disclaimers in sections 1 through 4, which reflect the fundamental nature of the service rather than a waiver of statutory rights.
